Property in occupied territory: lost access, physical damage or loss of a home

Match the category to the loss

• A3.6: an owner lost access or control because of occupation. Being abroad or personally unable to travel to property in unoccupied territory is not sufficient for this category. ^{[7] [8]}
• A3.1: an owner’s housing was physically damaged or destroyed; location in occupied territory does not itself exclude a claim. If the building’s condition is unknown, do not present suspected destruction as an established fact. ^{[4] [1] [2]}
• A3.3: a person lost the home where they actually lived, including because of occupation, hostilities, danger or destruction. A tenant, family member or other resident may have this claim without ownership. Owning a property where you did not live does not by itself establish an A3.3 claim. ^{[6] [9]}

One event can cause several distinct losses. An owner who lived in the housing may submit the relevant separate categories if their conditions are met; describe the relevant harm in each claim, and provide information about other claims, proceedings or payments as requested by that particular form. Several claims do not guarantee several payments for the same loss. ^{[6] [7] [9] [5]}

State when and how control was lost

For A3.6, access or control must have been lost on or after 24 February 2022. Occupation since 2014 does not by itself move an earlier loss into that period. The FAQ does, however, cover situations where an owner could still use previously occupied property periodically and lost that ability because of the full-scale invasion. Explain your sequence of events and the link to the later loss. ^{[7] [2]}

If access or control was later restored, the period of loss may still be claimed. If restoration occurs after submitting A3.6, update RD4U through the available Diia claim-update route. Do not continue describing the loss as ongoing after control has returned. ^{[7] [2] [5]}

Unregistered title or limited documents

Check the ownership information. Where registration is impossible, the A3.6 FAQ permits a claim with evidence of an attempted registration or an explanation of why no attempt was made, together with other available ownership evidence. This differs from A3.1, whose FAQ requires evidence of an attempt. The A3.6 form asks for the location, ownership and claimant’s share, circumstances of lost access or control, and an estimated claim amount with information about the property’s value before 24 February 2022. Each co-owner submits their own claim for their share. If coordinates are unknown or evidence of lost access or value is unavailable, the FAQ permits submission with as much information as possible. This does not turn unknown figures into proven facts or remove ownership requirements. ^{[7] [2] [8]}

Act without returning to danger

Organise existing title documents, extracts, messages, photographs and other material you can already obtain safely. Distinguish personal knowledge, information from others and what remains unknown. This is an organisational method, not a requirement to possess every item listed. Do not travel into occupied territory to obtain new material.

Remote inspection under Ukrainian Resolution No. 815 is not a universal way to establish destruction in occupied territory: its special rules expressly exclude it. At the same time, the absence of a Ukrainian inspection does not make A3.6 unavailable or establish physical destruction. Provide information about the loss you can actually describe. ^{[3] [2] [1]}
