A claim and its outcome
Reparation. The broad concept of redressing harm. The available forms and conditions in this section depend on the relevant procedure.
Compensation. Monetary redress. Deciding its amount and actually paying it are separate acts. [1]
RD4U claim. A request to record damage, loss or injury in the Register. It uses the relevant category form; reporting an event elsewhere does not automatically submit an RD4U claim. [2]
Recording. An RD4U Board decision that the claim meets the recording criteria. It is not a compensation award or payment decision. Submission is the earlier step of completing and electronically signing the form through Diia. [2]
People and authority
Claimant. The person in whose name a claim is submitted. For A2.1/A2.2, this is a family member claiming for their own mental pain and anguish, rather than submitting on behalf of the deceased or missing person. [2] [3] [4]
Representative. A person duly authorised under the procedure’s rules to submit or manage a claim for the claimant. Digital authority under RD4U rules is issued through Diia for a specified category or management of claims; implementation is phased. [5]
Immediate family member. In A2.1/A2.2, parents, spouses or civil partners and children as defined by those category rules, including specified adoptive and step relationships. Other family members face additional requirements concerning close ties and dependence. See “Death or disappearance of a family member”. [3] [4]
Harm, records and sources
Loss of housing or residence. In A3.3, loss of the place that served as the claimant’s home. It differs from an owner’s claim for physical property damage in A3.1 and loss of access or control in A3.6. [6] [7] [8]
Evidence. Material supporting a fact, such as a document, digital data, a photograph, video or other accepted material. RD4U receives evidence digitally; the category form specifies required and additional information. [2]
Primary source. A legal instrument, decision, form or communication issued by the responsible body. A legal rule and an official FAQ serve different purposes: an FAQ explains application but does not amend the rule.
Editorial recommendation. The authors’ practical conclusion, such as how to organise records. It is not legislation, an RD4U rule or a decision on a claim.
Institutions
Council of Europe. The international organisation within whose framework RD4U was established and the Claims Commission Convention concluded. European Union. A separate organisation that itself participates in the mechanism. The Council of Europe is distinct from the European Council and Council of the EU.
