Council of Europe: distinct institutional powers

The ECtHR applies the European Convention on Human Rights; “The ECtHR: jurisdiction, filing deadlines and redress” explains individual applications. RD4U receives and processes claims and evidence for recording but does not determine liability or award compensation. Convention CETS No. 229 establishes the legal framework for the International Claims Commission; “The Register, the Commission and payment” explains its current establishment stage and the separate issue of payments. When the EU Charter applies

Article 51 addresses the Charter to EU institutions, bodies, offices and agencies, and to Member States only when implementing EU law. It does not extend EU competences. Citing the Charter therefore does not by itself establish a procedure for recovering war damage from Russia or a universal payment entitlement. ^[4]

The Victims’ Rights Directive

Directive 2012/29/EU concerns victims’ information, support, protection and participation in criminal proceedings. It requires non-discriminatory application of rights, including irrespective of residence status. Article 8 provides access to free, confidential support according to need; access must not depend on making a formal criminal complaint. Applicable national rules and the particular circumstances still matter; living abroad does not itself establish a universal claim for compensation for every loss in Ukraine. Articles 1, 3–4, 8 §§ 1 and 5, and 17. ^[3]

The amendments made by Directive (EU) 2026/1472 entered into force on 20 July 2026. The main national transposition deadline is 2 July 2028; for the information and communication technology means under Article 26b it is 2 July 2030. A new provision’s inclusion in the consolidated text does not establish that every new service is available in a particular country. Previously implemented rights remain unaffected. A separate date governs the new rule against disclosure of a victim’s address and equivalent contact details to the offender: it applies to criminal proceedings initiated after 2 July 2029. Disclosure remains possible where necessary for the purposes of Article 7 of Directive 2012/13/EU or where the competent authority, after an individual assessment, establishes an overriding legitimate interest in disclosure. This is the scope of a specific rule, not a third deadline for transposing all amendments. Funding Ukraine and compensating individuals

The Ukraine Facility for 2024–2027 covers support for reforms and investments under the Ukraine Plan, an investment framework and technical assistance. It finances recovery and accession preparations. Regulation (EU) 2024/792, Articles 1–3, consolidated version of 27 February 2026. ^[5]

The Ukraine Loan Cooperation Mechanism under Regulation (EU) 2024/2773 provides non-repayable support to Ukraine for repayment of macro-financial and eligible bilateral loans, including principal, interest and related costs. It is not an individual application process for a war-damage award. Articles 1–5. ^[6]
